Terror Roulette is an interactive theatrical experience. The following may occur and You have knowingly and voluntarily assumed all such risks associated with the event, including, but not limited to:
a. You will be exposed to foul & suggestive language, bright lights, complete darkness, loud noises, and claustrophobic environments, fog, and other sensory effects.
b. Your clothing may get wet or stained
c. Actors may use personal contact to guide you through the attraction
d. You may receive a low-power static electric shock, with similar sensations to a puppy training pad.
f. You may be exposed to latex, grass, ink, burlap, chocolate/cocoa, red food coloring, soy sauce and a variety of scents.
Terror Roulette is not a family-friendly experience and not recommended for children.
You will be removed from Terror Roulette, without refund, for violating any rules, warnings or directions.
If you wish to leave Terror Roulette before the end of the attraction, you may tell any cast member the code word “RABBIT RABBIT RABBIT” and you will be escorted out of Terror Roulette without refund.
Your participation in Terror Roulette is be recorded and you release and waive all rights to the use of your appearance, name, voice, image, likeness, and/or biographical information for any use whatsoever.
You certify that you do not suffer from any health or medical conditions (INCLUDING ALLERGIES) that preclude your participation in Terror Roulette. If you require any accommodations, for any reason, YOU ARE REQUIRED TO INFORM TERROR ROULETTE 48 HOURS IN ADVANCE OF YOUR PARTICIPATION.
You have fully waived and released any and all liability of entities associated with the organization, management, and production of Terror Roulette.
You have agreed to indemnify and hold harmless all entities associated with the organization, management, and production of Terror Roulette from any and all claims arising from your participation in Terror Roulette.
In consideration of my participation in Terror Roulette (“the Event”), which is organized and produced by Iron, Wood & Glitter LLC d/b/a IWG Productions and The Arboretum of South Barrington, Inc. (collectively, “the Organizers”), I understand, acknowledge, and agree as follows:
1. Knowing and Voluntary Participation. I understand and acknowledge that my participation in the Event is both knowing and voluntary.
2. Assumption of Risk. I understand and acknowledge the nature and character of the Event, a unique and interactive environment designed to maximize fright, anxiety, and panic, poses various known risks, including, but not limited to, slipping, tripping, falling, trampling, bumping, and colliding; physical contact by individuals and moving objects; darkness, poor visibility, strobe lights, flashing lights, mirrors, loud noises, fog, dust, smoke, foul odors, and related effects that create disorienting impacts; wet, slick, moving, and/or uneven surfaces; intentionally and/or inadvertently confusing walkways, pathways, and points of ingress and egress; temporary heating sources; becoming entangled by ropes and cords; obstacles and obstructions; foul language; and other aspects or indicia of haunted houses that test a participant’s physical and mental limits and that impact the release of adrenaline and endorphins and that otherwise intentionally or inadvertently induce surprise, anxiety, panic, fear, fright, dizziness, and emotional distress. I also understand and acknowledge the nature and character of the Event and the various unknown risks that are or could be related or attendant to participation in the Event and similar events. I fully, freely, intelligently, and voluntarily assume all such risks, both known and unknown, obvious and non-obvious, inherent or not, and all such responsibility for any harm, injury, illness, or loss that may occur as a result of attendance at or participation in the Event, even if arising from the negligence, carelessness, or fault of Organizers or from dangerous or defective equipment or property owned, used, maintained, or controlled by Organizers. I further acknowledge that the risks, both known and unknown, obvious and non-obvious, inherent or not, associated with my participation in the Event may result in personal injury, property damage, property loss, or other harm or injury.
2.1. I further understand and acknowledge that participation in the Event can be dangerous and risky and that, in addition to those risks set forth in Paragraph 2, additional risks may include the presence of and contact with latex; burlap; inks, low-voltage static electrical shock; claustrophobia; grass, chocolate/cocoa, red food coloring, soy sauce and a variety of scents.; visual representations of abuse; fog; artificial scents; and otherwise engaging in physical, emotional, and strenuous activities, any or all of which can result in serious physical or emotional injury, disability, disfigurement, property damage, or property loss.
3. Waiver and Release of Liability. I hereby release Organizers, including their respective parent companies, subsidiary companies, affiliates, owners, members, partners, shareholders, officers, employees, agents, representatives, contractors, heirs, successors, and assigns (“Released Parties”) from any and all claims, allegations, demands, actions, causes of action, suits, losses, liabilities, obligations, settlements, judgments, and expenses (including, but not limited to, reasonable attorneys’ fees and costs) which arise out of, relate to, or result from any injury, illness, loss, or harm that is in any way related to the Event that occurs to me or my property during the Event, including any claims for personal injury, property damage, property loss, or wrongful death that may arise from, relate to, or result from the negligence of Organizers. This release includes any and all liability on account of any and all claims, allegations, demands, actions, or causes of action, whether at law or in equity or otherwise, whether in contract or tort, or pursuant to any statute, ordinance, or regulation, whether direct or indirect, whether known or unknown, whether contingent or non-contingent, whether presently discoverable or undiscoverable, whether suspected or claimed, which I could ever have against Organizers arising out of, relating in any way to, or respecting in any manner the Event, my voluntary participation in the Event, and the risks, inherent or otherwise, in my participation in the Event, including, but not limited to, the following:
a. premises liability;
b. active or passive conduct;
c. negligence in the failure to warn or in the selection, assembly, use, and/or maintenance of any equipment, facility, or services in connection with the Event;
d. negligence in the enforcement or implement (or failure to enforce or implement) any rules, regulations, guidelines, conditions, or procedures concerning the Event;
e. negligence in the failure to warn of any condition or circumstances of the Event or regarding the use of any product, facility, or service associated with the Event;
f. negligence regarding the giving (or failing to give) advice, directions, instructions, training, or recommendations concerning the Event; and/or
g. negligent rescue operations or efforts.
4. Indemnification and Hold Harmless. I agree to indemnify and hold harmless the Released Parties from and against all allegations, claims, demands, actions, causes of action, suits, damages, liabilities, obligations, losses, settlements, judgments, costs, and expenses (including, but not limited to, reasonable attorneys’ fees and costs) brought by any third party that arises from, relates to, or results from my participation in the Event, including, but not limited to, any and all claims for negligence or other actions, behavior, conduct, or omissions that give rise to any legal claim or cause of action. I further agree that, in the event of my death or disability, the terms of this Agreement, including this indemnification provision, shall be binding on my estate, and my personal representative, executor, administrator, or guardian shall be bound by this Agreement, including this indemnification provision.
5. Severability. In the event any provision of this Agreement is determined to be void or unenforceable, such determination shall not affect the remainder of this Agreement, which shall continue to be in force.
6. Governing Law. The validity, construction, and performance of this Agreement shall be construed in accordance with, and governed by, the laws of the State of Illinois.
7. Media Release. I understand and acknowledge that my participation in the Event may be recorded (whether by audio-visual and/or photographic means) (the “Materials”). I hereby release, waive, discharge, and covenant not to sue the Released Parties from and against any and all liability in any manner connected with the use and exercise of the rights granted and/or arising out of or related to the use or reuse of my appearance, name, voice, image, likeness, and/or biographical information as they may appear in the Materials (including, without limitation, claims based upon harm to reputation, disparagement, invasion of privacy, and/or publicity) in connection with the Materials. I hereby authorize Organizers to use the Materials for any purpose whatsoever, including, but not limited to, in connection with any other production, the advertising, promotion, and/or merchandising of the same, and further acknowledge that such recordings may be exploited in any and all media now known or hereafter devised, throughout the world, in perpetuity. I understand and agree that I shall not be entitled to any compensation in connection therewith.
8. PARENTS AND/OR GUARDIANS OF PARTICIPANTS UNDER THE AGE OF 18. This is to certify that I, as parent/guardian with legal responsibility for this minor participant, do consent and agree to all terms and conditions set forth in this Agreement on behalf of the minor participant.
I acknowledge and represent that I have carefully read this Agreement; understand the terms and conditions contained in this Agreement, including the release of liability and waiver of other legal rights, the assumption of risks, and the indemnity and hold harmless obligations; and fully, freely, knowingly, and voluntarily enter into this Agreement.
